1. Acceptance of terms
The PEXTH platform (“the Platform”) is operated by Perke Innovation and Technology Co., Ltd. (“the Company”, “we”, or “us”). By registering, signing in, or using any part of the Platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Notice. If you do not accept them, please do not use the service.
If you use the service on behalf of a company or legal entity, you represent that you have the authority to act for and bind that entity to these Terms.
2. Definitions
- User
- Any person who accesses or uses the Platform, whether registered or not.
- Customer
- A user who searches for providers, submits project details, or receives quotations through the Platform.
- Partner
- An energy company or operator that registers a profile on the Platform, including the users who are its owner, managers, or team members.
- Project (RFQ)
- A request for quotation submitted by a customer through the Platform.
- Lead
- A project that the system routes to a particular partner.
- Package
- An annual partner membership plan: Gold, Silver, and Bronze.
3. User accounts
- You must have reached the age of legal majority, or have the consent of your legal guardian, in order to register.
- You must provide accurate, current, and complete information and update it whenever it changes.
- You are responsible for keeping your password and authentication devices secure. We recommend enabling two-factor authentication.
- You are responsible for all activity that occurs under your account and must notify us immediately if you discover any unauthorized use.
- An account belongs to a single individual. Do not transfer, sell, or let anyone else use your account.
- Signing in through Google, Facebook, or LINE is also subject to those providers’ terms.
4. Partner verification (PEXTH Verified)
- Partners must register truthful company information and may be required to submit supporting documents, such as a certificate of company registration, VAT registration, relevant licenses, or evidence of past work.
- Our team reviews the information and decides whether to approve or reject the verification. We may request additional information and will state the reason when we reject it.
- The Gold Verified, Silver Verified, and Copper Verified badges show that the company information was reviewed at the time of the check and indicate the partner’s package tier. These badges are not a guarantee of the partner’s work quality, pricing, or performance.
- Partners must keep their information current. Editing key information that has already been verified may require re-verification.
- We may revoke a verification badge or suspend a profile if we find that the information is inaccurate or that the partner is in breach of these Terms.
5. Packages and payment
- The Gold, Silver, and Bronze packages are annual plans. Prices and benefits are as shown on the partner packages page at the time of purchase, including any tax stated on the payment record.
- Each package’s benefits — such as the number of photos and videos, display placement, lead priority, the maximum project size eligible for leads, the number of languages, and coupons — apply only while the package is active.
- Payment is made via PromptPay or bank transfer to the Company’s account, with proof of payment uploaded in the partner portal. A package becomes active once our team confirms the payment and remains valid for one year from its activation date.
- Packages do not renew automatically. On expiry, the profile reverts to ordinary member status until it is renewed or a new package is purchased.
- Discount coupons may be used according to the conditions of each coupon and cannot be exchanged for cash or transferred.
- Fees for a package that has already been activated are non-refundable, except where required by law or where we are unable to provide the package for reasons attributable to us, in which case we will consider a refund proportionate to the remaining period.
- We may adjust package prices or benefits in the future without affecting a package that has already been paid for and activated.
6. Projects, leads, and quotations
For customers
- Submitting project details is free of charge. You must provide truthful project and contact information and consent to our sharing it with the matched partners.
- The system matches projects with partners based on service type, area, project size, and package priority. We do not guarantee how many partners will respond or how many quotations you will receive.
- Quotations and service contracts are agreements directly between you and the partner. Clicking “Accept” or “Decline” on the Platform expresses your intent to the partner and does not yet constitute a service contract until you and the partner enter into a contract yourselves.
- Please verify the details, licenses, warranties, and payment terms with the partner before you decide.
For partners
- Use the customer’s project and contact information only to make contact, ask for details, and quote for that project. Do not sell it, disclose it to others, or use it for unrelated marketing.
- The partner is an independent controller of the personal data it receives about customers and must comply with the Personal Data Protection Act B.E. 2562 (2019).
- Partners must contact customers politely and professionally and provide accurate pricing and terms.
- The number and quality of leads depend on customer demand at any given time. We do not guarantee the number of leads or the sales a partner will receive.
7. Review rules
- A review must come from your genuine experience with that company. Each user may post one review per company and may edit it later.
- Do not review a company that you own, manage, or are a team member of, and do not review competitors in order to damage their credibility.
- Do not create fake reviews, buy or solicit paid reviews, or offer incentives in exchange for reviews without disclosure.
- Do not include another person’s personal information, profanity, hate speech, defamatory statements, or unlawful content.
- We may hide or remove reviews that break these rules. Reviews are the opinions of their authors, not of the Company.
8. Content and intellectual property
The software, design, the PEXTH trademark, and content produced by the Company are the intellectual property of the Company. Do not reproduce, modify, or use them without written permission.
You retain ownership of the content you upload — such as logos, images, videos, portfolio information, and reviews — and you grant the Company a non-exclusive, royalty-free, worldwide license to store, display, resize or reformat, and publish that content in order to operate and promote the Platform, for as long as that content remains on the Platform.
You represent that you hold lawful rights to the content you upload and that it does not infringe the rights of others. If you believe any content infringes your copyright, please notify us at [email protected] with details so that we can review and take action.
9. Prohibited use
- Providing false information, impersonating another person or company, or creating a profile for a company that does not exist.
- Submitting fake projects or spam, or using the Platform to deceive or defraud.
- Extracting data from the Platform by automated means (scraping/crawling) or harvesting users’ contact information without written permission.
- Attempting to breach the system, circumvent security measures or rate limits, access other people’s accounts, or reverse-engineer beyond what the law permits.
- Uploading malware, or content that is unlawful, obscene, defamatory, or infringes the rights of others.
- Harassing, threatening, or disturbing other users, partners, or staff.
- Creating multiple accounts to distort reviews, ratings, display ranking, or lead matching.
- Doing anything that violates Thai law or that damages the Platform’s systems or causes them to malfunction.
10. Suspension and termination
We may suspend or terminate an account, hide a profile, or restrict some functionality immediately if we have reasonable grounds to believe that you are in breach of these Terms or the law, or that your use is causing harm to other users or the Platform. Where use is terminated because of a breach, we have no obligation to refund fees already paid for a package.
You may request to close your account at any time by contacting us. Your data will be handled in accordance with the Privacy Notice.
11. Limitation of liability
- The Platform is provided on an “as is” and “as available” basis. We strive to keep the system running continuously and accurately, but we do not warrant that it will be free of errors or interruptions.
- Results from the solar calculator and other supporting information are preliminary estimates only; they are not engineering or financial advice, and they are not a quotation.
- The Company provides a connecting platform and is not a party to any sale or engagement between customers and partners. It is not liable for work quality, pricing, delays, warranties, or disputes between customers and partners.
- To the extent permitted by law, the Company’s total liability to you will not exceed the amount of fees you paid to the Company in the 12 months before the event giving rise to the damage.
- This limitation of liability does not apply to damage caused by the Company’s willful misconduct or gross negligence, or where consumer protection law prohibits limiting liability.
12. Indemnity
You agree to indemnify and defend the Company, its directors, and its employees against claims, damages, and reasonable costs (including legal fees) arising from your breach of these Terms, your violation of the law, or your infringement of the rights of others, including the content you upload.
13. Changes to the terms
We may amend these Terms from time to time. We will show the latest effective date at the top of this page and give reasonable advance notice of material changes by email or in-system notification. Continuing to use the service after the new Terms take effect means that you accept them.
14. Governing law and dispute resolution
These Terms are governed by and construed in accordance with the laws of the Kingdom of Thailand. The parties will first attempt to resolve any dispute through good-faith negotiation; if they cannot reach agreement, the competent Thai courts will have jurisdiction over the dispute.
If any provision of these Terms is invalid or unenforceable, the remaining provisions will continue in full force and effect.
